The driver shall only contact Bayernsped Int. Speditions GmbH using the order or loading numbers provided. Unless otherwise agreed, any direct contact is prohibited.

The carrier is solely responsible for loading the goods in a manner that is safe for traffic, transport and transportation.

The contractor must submit the permits required for the execution of the order and ensure that the official requirements are complied with.

It is agreed that the goods will be accepted by the piece, checked for identity and inspected for externally visible damage. This service is part of the freight contract.The customer must ensure that his own loaded motor vehicles and trailers, or those of third parties within his sphere of influence and responsibility, are secured against theft or robbery, especially at night, on weekends and public holidays.

When transporting temperature-controlled goods, only vehicles and trailers with an ATP certificate and refrigerated recorders are to be used, the temperature to be maintained must be noted in the transport document and the drivers must be instructed to regularly check and document compliance with the temperature during transportation.

You are fully liable for all damages resulting from non-compliance with this contract of carriage.

Loading equipment must be exchanged on a train-by-train basis. Loading equipment that has not been exchanged must be returned carriage paid within three days of collection. Upon presentation of the proof of delivery, the corresponding pallet bills must be presented.

You accept an immediate charge of up to € 13.00 per Euro pallet, € 20.00 per Düsseldorfer pallet and € 160.00 per lattice box pallet for loading equipment that has not been exchanged.

In the event of obstacles to delivery or non-pure receipt, for whatever reason, the dispatch department must be notified immediately on 08166-99 120. This number is available 24 hours a day.

All costs arising from non-compliance with these instructions shall be borne by the carrier.

Orders can only and exclusively be issued by Bayernsped Int. Speditions GmbH.

All others shall be deemed invalid. All costs arising from misconduct shall be borne by the contractor (carrier).

The Contractor shall be liable for all transport damage in the full amount of the damage.

Any limitations of liability shall be waived as far as possible. If, necessary separate transport insurance must be taken out. If there is a maximum liability limit, e.g. due to legal regulations that cannot be waived, the most favorable rate for the claimant must always be applied. This is e.g. CMR 8.33 SDR, TRG 40 SDR per kilogram gross weight.It is expressly agreed that the carrier has taken out CMR insurance or corresponding transport insurance valid up to the time of transportation and has paid the premiums for this.

Assignments of freight claims may only be made with the express written consent of Bayernsped Int. Speditions- GmbH.

The place of jurisdiction is also Munich.

Should individual provisions of the agreement prove to be invalid, the remainder of the agreement shall continue to apply. The omitted provision shall be replaced by a valid provision that corresponds as closely as possible to the purpose of the omitted provision.

We work exclusively on the basis of the "German Freight Forwarders' Standard Terms and Conditions" (ADSp) latest version, and have taken out forwarding insurance in accordance with clause 29 ADSp.
